a. IN NO EVENT SHALL LIVER SCAN DIRECT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES.

b. LIVER SCAN DIRECT'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU, IF ANY, TO LIVER SCAN DIRECT DURING THE SIX MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

11. SMS Opt-In Policy

a. By providing your mobile phone number and opting in to receive SMS messages from Liver Scan Direct, you consent to receive text messages from us, including but not limited to reminder messages, alerts, and updates related to Fibroscan appointment.

b. Message and data rates may apply. You are responsible for any fees charged by your mobile carrier for receiving SMS messages.

c. You may opt out of receiving SMS messages from us at any time by texting "STOP" to 416 268 0150. You may also opt out by contacting us through email at info@liverscan.ca

d. Opting out of SMS messages will not affect your use of our Services.

e. By opting in to receive SMS messages, you acknowledge that you are the subscriber or authorized user of the mobile phone number provided and that you have the authority to consent to receive SMS messages from us.

f. Liver Scan Direct respects your privacy. We will not share your mobile phone number with third parties for marketing purposes without your consent. Your mobile phone number will only be used for the purposes outlined in this SMS Opt-In Policy.

g. Liver Scan Direct reserves the right to modify or terminate the SMS opt-in program at any time without notice.

12. Consent for Fibroscan Exam

a. By scheduling and undergoing a Fibroscan exam at at any of our listed locations, you acknowledge that you have read, understood, and consent to the following terms and conditions:

b. The Fibroscan exam is a non-invasive procedure used to assess liver stiffness, which may indicate the presence of liver fibrosis or cirrhosis.

c. You understand that the Fibroscan exam involves the use of ultrasound technology to measure liver stiffness and does not involve the use of needles or incisions.

d. You consent to undergo the Fibroscan exam and understand that the results will be used by your healthcare provider to assess the health of your liver and determine appropriate treatment or follow-up care.

e. You understand that while the Fibroscan exam is generally considered safe, there may be rare risks or complications, such as discomfort during the procedure or inaccurate results.

f. You agree to follow any pre-exam instructions provided by your healthcare provider, including fasting or avoiding certain medications as directed.

g. You understand that the Fibroscan exam is not a substitute for other diagnostic tests or medical evaluations and that additional testing or procedures may be necessary based on the results of the exam or your medical history.

h. You have had the opportunity to ask questions about the Fibroscan exam, and your questions have been answered to your satisfaction.

i. You consent to the use of your personal health information for the purpose of scheduling, conducting, and documenting the Fibroscan exam, in accordance with applicable privacy laws and regulations.

j. You understand that you have the right to refuse or discontinue the Fibroscan exam at any time, and that doing so may have implications for your healthcare and treatment options.

By booking and appointment online, over the phone or otherwise indicating your consent, you acknowledge that you have read, understood, and agree to the terms and conditions outlined in this Consent for Fibroscan Exam.

13. Collection of Data

a. By using our services or participating in any activities offered by Liver Scan Direct, you acknowledge and consent to the collection, storage, and processing of your personal data as outlined in this policy.
